Throughout the following Terms and Conditions, the words “we” “us” and “our” refer to MSS Holdings (UK) Ltd/Huey.co.uk and the words “you” and “your” refer to you the customer.

WEBSITE TERMS
You can access our website, including all the information, tools and services within the site and in accordance with these Terms and Conditions. Please read them all carefully.

We reserve the right to replace or amend any part of these Terms and Conditions by updating the changes to our website. Please check this page periodically for any changes. Your continued use of the website constitutes your acceptance of any changes.

We reserve the right to withdraw, either temporarily or permanently, our website with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the site.

We reserve the right to amend the prices payable for flights or vouchers.

We reserve the right to refuse access to and use of our website for any reason at any time.

Material on the website is for your personal use only. You cannot copy or use any of the material or content for your own personal use, or send any unsolicited material to any third party. You cannot send any data or material that contains any type of virus.

You must comply with all applicable local, national or international law regulations regarding the use of the website.

You agree and acknowledge that all copyright, trademarks and all other intellectual property rights, material and content within the website belong to us.

We cannot be held responsible if the information on our site is not accurate, complete or current. We cannot make a warranty that your use of the site will not be interrupted or error free or that our website or the server that makes it available to you are free of viruses or bugs. We will not be responsible or liable for any loss of content or material uploaded or transmitted through our site.

All material on our website, including descriptions, photographs, and literature provided by us is for general information only and is intended only to represent a general picture of our services. It should not be relied upon or used as a sole basis for making decisions and shall not form any part of any contract that is formed under these Terms & Conditions.

By using our site, you represent that you are at least 16 years of age.

FLIGHT CONTRACTS
The contract between us will be formed at the time you book your flight, and payment has been received in full. You will receive an email or letter form us confirming your booking.

Bookings will be made online.

Payments will be made online. The full price of the flight may be paid at the time of booking, either by credit/debit card or by the redemption of a valid voucher. The price is inclusive of VAT and is in GB pounds. Alternatively a deposit scheme has been implemented to assist with payment installments. Bookings must be payed for in full 4 weeks prior to your flight date. A reminder will be sent out to you 5 weeks before your flight date.

When paying for a flight or voucher online, you will be directed to our payment gateway company’s server. We use Stripe to process all transactions. Your card details will be saved by Stripe if you opt in to this service. We do not hold, save or process any card or payment details.

No booking will be confirmed until payment in full has been received.

When you make a booking you will confirm that you are, or will be on the day of the flight, over the age of 18. You will confirm that you accept all the Terms and Conditions and that you accept all risks under the terms of SSAC guidelines. CLICK HERE FOR SSAC INFO

Flights are available on selected dates throughout the year. Dates and availability can be viewed on our website or by contacting our office.

We reserve the right to postpone or cancel a flight. If we need to cancel a flight due to weather or aircraft serviceability/ technical issues we will offer you an alternative date.

We reserve the right to rearrange pre-booked flights if the minimum number of passengers quota is not met. The minimum number of passengers is 4 people and the maximum is 5 people. This is also stated in our Frequently Asked Question section. Alternative dates may be re-arranged if the date provided is not suitable for customers.

We will give you as much notice as possible if we need to cancel the flight. We cannot be held liable for any costs incurred by you in relation to a flight that has to be cancelled or postponed.

You must arrive by the time specified to you. Failure to do so may result in forfeiting your flight.

You may cancel a flight at any time up to the date of the flight. A full refund of the amount paid to date will be given. Please give us as much notice as possible so that we may offer your booking to somebody else.

You may amend a booking by contacting us by email or telephone.  Please allow at least 7 days notice. We will do our best to meet any requests for amendments.

If at any time before engine start, you decide that the level of risk is unacceptable to you, you may cancel.

If you cancel your flight we will refund the full amount paid to date to the original purchaser of the voucher.

The Huey Flight Experience is unable to reimburse travel, accommodation or other incidental expenses incurred by you in attending an experience which is cancelled for any reason.

We reserve the right to remove you from the flight or to land early, if, in the pilot’s opinion, you are physically or medically unable to fly, or if the pilot deems you to be danger to yourself, other passengers, the crew or the aircraft.

You must be at least 18 years of age to participate in a flight. We may ask for proof of age.

We reserve the right to refuse you to undertake the flight, if the pilot feels you are unsuitable for any reason.

You must inform us of any disabilities or health problems that may affect your safety or the safety of the other passengers or crew.

You must not drink any alcohol or take any drugs on the day of you flight. We reserve the right to breathalyse you if we suspect you may be under the influence of alcohol.

RISK
Before you participate in a flight, you must read and understand the “Safety Standards Acknowledgement and Consent document” “SSAC Document”. This document outlines the risks involved when participating in a flight in an aircraft which does not meet the safety standards of commercial aircraft.

We will not allow a passenger to fly until we are certain that he/she has fully understood the levels of risk and safety involved with the flight. You must not participate in a flight unless you are certain that you understand the levels of risk and safety involved. Participating in a flight may result in serious injury or death.

By agreeing to be a passenger, you accept the elements of personal risk as set out in the SSAC document. The risks will be explained to you more fully during the pre-flight briefing. During the briefing you must watch a safety video and participate fully in the session. You will be required to sign a SSAC declaration form before you are permitted to fly. 

We will not allow any passenger to fly until they have participated in the pre-flight briefing, watched the safety video and signed the SSAC declaration.

You must follow all instructions given to you by the pilot or any crew member at all times to ensure the safety of yourself, fellow passengers and our crew.

You will be provided with suitable personal protective equipment, a flying suit, before the flight. You must provide your own wear suitable footwear. These should be sturdy and flat and be non slip. Sandals, flip flops or heels are not suitable.

Guests
You may bring up to 3 guests. Guests may use the visitor centre which provides toilets, refreshments (at a cost) and seating areas both inside and out. Guest will have the opportunity to look around the hangar.

Guests will be required to participate in a short health and safety briefing.

No dogs (except assistance dogs) are permitted. Assistance dogs will only be allowed in the visitor centre, not in the hangar.

General Rules and Information
Smoking is not permitted anywhere. This includes the use of e-cigarettes.

All visitors must be escorted by trained crew at all times.

All visitors must follow any and all instructions given by any member of crew at all times.

Cameras are permitted on the aircraft but must be secured to you by a strap either on your wrist or around your neck.

Photo opportunities will be available at the end of your flight.

Lockers will be provided to passengers to store bags/coats etc. No bags will be allowed on the aircraft.

 

 TERMS AND CONDITIONS APPLYING TO ALL CONTRACTS

Liability

i) Our liability, and all warranties, conditions and other terms implied by statute or common law, are excluded to the fullest extent permitted by the law.

ii) This Clause  sets out our entire financial liability to you (including any liability for the acts or omissions of our parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees ) in respect of:

(a) any breach of a Voucher Contract or Flight Contract by us; and

(b) any representation, statement or tortious act or omission (including negligence) by us arising under or in connection with a Voucher Contract or Flight Contract.

iii) Nothing in these Terms and Conditions limits or excludes our liability:

(a)for death or personal injury resulting from our negligence or the negligence of our employees or agents; or

(b) for any damage or liability incurred by you as a result of our fraud or fraudulent misrepresentation.

(iv )Save as provided above,

(a) we shall under no circumstances whatsoever be liable to you, whether in contract, tort (including negligence), or breach of statutory duty, or for any loss of profit or any indirect or consequential loss arising under or in connection with a Voucher Contract or Flight Contract between us; and

(b) our total liability to you in respect of all losses arising under or in connection with a Voucher Contract or Flight Contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price paid for the relevant Voucher or Flight.

v) We hereby exclude any liability for any sum that can be recovered under any insurance policy.

Force Majeure

We shall not be liable for any failure or delay in performing any of our obligations under a Voucher Contract or a Flight Contract to the extent that such failure or delay is caused an event beyond our reasonable control, including but not limited to strikes, lock-outs or other industrial disputes (whether involving our own workforce or a third party’s), failure of energy sources or transport network, threats to safety, acts of God, war, terrorism, riot, civil commotion, interference by civil or military authorities, national or international calamity, armed conflict, malicious damage, unservice, ability of the aircraft or of any other plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapse of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, unavailability of pilots (provided we have used reasonable endeavours to ensure a pilot is available), natural disasters or extreme adverse weather conditions, or default of suppliers or subcontractors.

Your Liability and Indemnification

i) You agree to indemnify, defend and hold harmless us and our parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

ii) You will be held liable if you cause damage to any of our property or equipment (including an aircraft) by your negligence or wilful act or omission.

Severability

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Miscellaneous

i) The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

ii) The appropriate sections of these Terms and Conditions constitute the entire agreement and understanding between you and us and govern, as applicable, any Voucher Contract or Flight Contract between us, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of these Terms and Conditions).

Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England, and you submit to the exclusive jurisdiction of the English courts in respect of any dispute arising out of them.
